The Law Office of Phillips & Millman, LLP makes numerous donations to charities, nonprofits and communities throughout Rockland County.

Phillips & Millman hosts the annual Phillips Tee-Off for Tots Golf Tournament fundraiser every summer to help a youth against a life-threatening illness.  Frank Phillips started the charity, which has raised over $200,000 for children with such illnesses.  Jeff Millman is the chairman of the board for the annual tournament that is heading into its 25th year.

The law firm contributes to the Rotary Club of North Rockland. In fact, Frank Phillips is a Rotary member and chairs its annual pancake breakfast. The firm supports the Stony Point Lions Club and the Haverstraw Elks Club #877, both of which Frank Phillips is a member.

Driving and Cell Phone Usage Carries Harsh Penalties

I remember driving Interstate 95 South to the University of Miami School of Law in the late 80′s.  Everywhere I turned the new technology known as “mobile phones” was the South Florida craze.  Aside from the fact these phones were more like portable shoe boxes in size the use of these phone introduced an extremely dangerous phenomena.

Auto accidents increased to record numbers directly related to the use of the mobile/cell phone.  When a driver operates their car they are charged with the responsibility to operate safely.  Pay attention to the road, the cars around you and the pedestrians that inevitably cross in front of your vehicle without notice.

Use of Cellular phone While Driving

Please note that effective July 12, 2011, a conviction for the vehicle and traffic ticket for the use of a cell phone while driving is now 3 points on your license with a fines up to $150 plus a $85 surcharge.  It is a primary offense where an officer may stop you if you are observed using a handheld device while driving.  Please note that the Law Offices of Phillips & Millman handle all traffic offenses including DWI.

Criminal Law Update– Charges may be dismissed if there is insufficient accusatory instrument

In the justice court, an accusatory instrument may consist of a misdemeanor information and attach a supporting deposition of the complainant.

If the defendant raises the issue of the sufficiency of an accusatory instrument in a motion, the Court may review the instrument and to determine whether it is legally sufficient. The accusatory instrument must specify the times and dates of the commission of the offense along with the requisite elements of the offense as it is set forth in the New York State Penal Law.

It’s time to check your insurance policy
